This Legal Notice (also referred to as our Terms of Service or Terms & Conditions) governs your access to and use of washproduct.com and any related Image Wash Products websites (the "Site"), and your purchase of any products from us. By accessing the Site or placing an order, you agree to be bound by this Legal Notice. If you do not agree, please do not use the Site or place an order.
This Legal Notice works together with, and does not replace, our Privacy Policy, Shipping Policy, and Return & Refund Policy, each of which is incorporated into this Legal Notice by reference. Where this Legal Notice and one of those policies address the same subject in conflicting terms, the more specific policy (Privacy, Shipping, or Return & Refund) controls for that subject.
About Us
Image Wash Products is based at 5144 Chicago Dr. STE 1, Hudsonville, MI 49426. We manufacture and sell truck and fleet wash chemicals, detailing chemicals, and related accessories and equipment.
Eligibility
You must be at least 18 years old to place an order on the Site. By placing an order, you represent that you are at least 18 years old and that you have the legal authority to enter into this agreement, whether on your own behalf or on behalf of a business you represent.
Intended Use of Products; Read All Labels and Safety Data Sheets
Our products are chemical products intended primarily for professional and commercial truck, fleet, and vehicle washing and detailing applications. You are responsible for reading and following the product label and the applicable Safety Data Sheet (SDS) for each product before use, including instructions for proper dilution, application, personal protective equipment, storage, and handling. SDS documents are available upon request at help@washproduct.com. Products must be used only for their labeled purpose and in accordance with all label directions and applicable law.
Environmental and Regulatory Compliance
You are solely responsible for complying with all applicable federal, state, and local laws and regulations relating to the storage, handling, use, discharge, and disposal of our products and any wastewater or runoff generated from their use, including any applicable requirements under the Clean Water Act, National Pollutant Discharge Elimination System (NPDES) permitting, local wastewater pretreatment or discharge ordinances, and hazardous waste regulations. Image Wash Products is not responsible for any fines, penalties, citations, or liability arising from your failure to properly contain, treat, or dispose of wash water, runoff, or waste generated in connection with the use of our products.
Assumption of Risk
Many of our products are corrosive, flammable, or otherwise hazardous chemicals. By purchasing and using our products, you acknowledge their hazardous nature and voluntarily assume all risks associated with their storage, handling, use, and disposal, including risks of personal injury, property damage, and environmental harm that may result from improper use, use inconsistent with the product label or SDS, or use by untrained personnel.
Product Descriptions, Pricing, and Availability
We attempt to display product descriptions, images, and pricing accurately, but we do not warrant that all information on the Site is complete, current, or error-free. We reserve the right to correct any pricing, typographical, or other errors, and to change or update information, prices, and product availability at any time without prior notice, including after an order has been submitted. If a product is listed at an incorrect price or with incorrect information due to an error, we reserve the right to cancel any order placed for that product, whether or not the order has been confirmed, and to refund any amount charged for the cancelled order. Product photos, including before-and-after or demonstration images, are illustrative; actual results may vary based on surface condition, water quality, dilution, application method, and other factors outside our control.
Order Acceptance and Right to Refuse Service
Your receipt of an order confirmation does not constitute our acceptance of your order; it is only confirmation that we received your order. We reserve the right, at our sole discretion, to limit or cancel quantities purchased, to refuse or cancel any order, and to refuse service to anyone, for any reason, including suspected fraud, suspected resale in violation of this Legal Notice, or errors in pricing or product information. If we cancel an order after payment has been collected, we will issue a refund to your original payment method.
Payment Terms
All prices are listed in U.S. dollars. You agree to provide current, complete, and accurate purchase and payment information for all purchases made on the Site. Applicable sales tax will be added to your order total based on your shipping address and applicable law.
Warranty Disclaimer
Except as expressly stated on a product label or in writing by an authorized representative of Image Wash Products, all products are sold "AS IS" and "WITH ALL FAULTS." To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that products will meet your specific requirements or that results from product use will be uninterrupted, error-free, or as depicted in marketing materials. Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you; in that case, any implied warranties are limited to the shortest period and narrowest scope permitted by law.
The Site itself is provided "as is" without warranty of any kind. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Limitation of Liability
To the fullest extent permitted by applicable law, Image Wash Products and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your purchase or use of our products or the Site, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any claim arising out of or relating to your purchase or use of our products or the Site will not exceed the amount you paid to us for the specific product giving rise to the claim.
This limitation of liability does not apply to liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our gross negligence or willful misconduct, where prohibited by law.
Indemnification
You agree to indemnify, defend, and hold harmless Image Wash Products and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use or misuse of our products, including any use inconsistent with the product label or SDS; (b) your violation of any applicable law or regulation, including environmental and wastewater discharge requirements; (c) your resale or distribution of our products to a third party; or (d) your violation of this Legal Notice.
Intellectual Property
All content on the Site, including text, graphics, logos, product names, images, and the overall look and feel of the Site, is owned by or licensed to Image Wash Products and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as necessary to place an order or make personal, non-commercial use of the Site.
User Content and Reviews
If you submit a review, testimonial, photo, video, or other content to us or through the Site, you grant Image Wash Products a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute that content in connection with our business, including in marketing materials, without additional compensation to you. You represent that any content you submit is your own original work and does not violate the rights of any third party.
Prohibited Use of the Site
You agree not to use the Site to: violate any applicable law; infringe our intellectual property or that of any third party; transmit any virus, malware, or harmful code; attempt to gain unauthorized access to the Site or its related systems; scrape, harvest, or collect data from the Site by automated means without our consent; or interfere with the proper functioning of the Site. We reserve the right to terminate or restrict your access to the Site for any violation of this section.

The Site may contain links to third-party websites that are not owned or controlled by Image Wash Products. We are not responsible for the content, privacy practices, or terms of any third-party website, and inclusion of a link does not imply our endorsement.

Dispute Resolution and Arbitration Agreement
Please read this section carefully, as it affects your legal rights.
Informal Resolution. Before filing a claim against Image Wash Products, you agree to first contact us at help@washproduct.com and attempt in good faith to resolve the dispute informally for at least 30 days.
Binding Arbitration. If a dispute is not resolved informally, you and Image Wash Products agree that any dispute, claim, or controversy arising out of or relating to this Legal Notice, your purchase, or your use of the Site will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, rather than in court, except that either party may bring an individual action in small claims court, and either party may seek injunctive or other equitable relief in court to prevent infringement or misuse of intellectual property.
Class Action Waiver. You and Image Wash Products agree that any arbitration or claim will be conducted on an individual basis only, and not as a class, collective, or representative action. The arbitrator may not consolidate more than one person's claims.
Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to help@washproduct.com within 30 days of the date you first place an order or otherwise accept this Legal Notice. Your notice must include your name, order number (if any), and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts identified in the Governing Law section below.
Force Majeure
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, labor disputes, carrier delays, supply chain disruptions, government action, or other similar events.
Governing Law and Venue
This Legal Notice is governed by the laws of the State of Michigan, without regard to its conflict-of-law principles. Subject to the Dispute Resolution and Arbitration Agreement above, any action not subject to arbitration will be brought exclusively in the state or federal courts located in Ottawa County, Michigan, and you consent to the personal jurisdiction of those courts.
Severability
If any provision of this Legal Notice is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No Waiver
Our failure to enforce any provision of this Legal Notice will not be considered a waiver of our right to enforce that or any other provision in the future.
Assignment
We may assign or transfer this Legal Notice, in whole or in part, without restriction. You may not assign or transfer your rights or obligations under this Legal Notice without our prior written consent.
Entire Agreement
This Legal Notice, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitutes the entire agreement between you and Image Wash Products regarding your use of the Site and purchase of our products, and supersedes any prior agreements or understandings on that subject.
Changes to This Legal Notice
We may update this Legal Notice from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Site or purchase of our products after a change becomes effective constitutes your acceptance of the revised Legal Notice.
